Pennsylvania Zoning Hearing Board Rules on CasinoSince casinos were not permitted use in Pennsylvania when Straban Township wrote its zoning ordinance, there is no area specifically zoned for gambling facilities. So the hearing is supposed to determine how casinos fit into existing code. The proposed site is zoned commercial highway and hotels are permitted use. After listening to two hours of testimony from six people and argument from five lawyers, the Straban Township Zoning Hearing Board adjourned Monday's hearing on a proposed slots casino and will reconvene next week to hear more. The hearing was scheduled as part of the township's review of a plan submitted by Crossroads Gaming Resort and Spa to build a slot parlor, restaurant, spa, parking lots and a garage on a site near routes 15 and 30. Crossroads' attorney Jeffrey Ernico and his co-counsel argued Wednesday that the project should qualify under the commercial highway zoning district, and if it doesn't, the zoning hearing board could rule it qualifies for a special exception in that district. If it doesn't qualify for either, then he said the zoning ordinance is unconstitutional because it doesn't permit a casino anywhere in the township. Crossroads had a few backers at the hearing, although attorney John Dougherty represented four Starban Township residents who are in favor of the project. They are also considered parties to the case. |
